I placed a good size order with addicted to rubber stamps. They sent me the DC# and I checked yesterday to see where the package was. It had been delivered two days ago. I called addicted to rubber stamping and explained that the DC# said it was delivered and I had not recieved the package, the guy said that I would need to call the post office and take it up with them. I asked him if the post office can not find it am I out $60.00 worth of stuff. He said yes! I am sooooooo upset because I needed that stuff to do a swap plus some cards that friends had ordered. I am also upset because I do not have the money to replace the items, I am a new single mother of two and money is very tight..
Has this happen to anyone else?? Is there hope that I will get my package??
The company is RESPONSIBLE to ensure this package gets to you.
You can call USPS for info but it probably will not get you to far.
By law addicted to rubber stamps will have to replace it if it is lost.
They will have to send you a replacement and then file a claim with USPS themselves for the lost package.
You are not responsible - the seller is.
I work witht his stuff everyday and we deal with this exact situation daily so I know.
If they refuse - file a chargeback with your CC or a dispute with Paypal.
They will side with you.
Or tell them you are filing a complaint with USPS.
This is one thing that stops me from ordering from certain companies and on ebay as some sellers/stores believe once they ship they are not responsible whenin fact they are.
DC and insurance protects the sellers - not the buyers.
Without either CC and paypal will side with the buyer.
The seller will still have to reship/refund but they will get their money back from the lost package claim from USPS.
USPS regulations do state that a seller must get the package to the buyer in the condition it was purchased in. If not then the seller is responsible for replacing it or refunding the money.

I am really surprised that an on-line store as big as Addicted to Rubber Stamps would be so stupid in customer service. If the package did not arrive then they are responsible, not you the customer. I would check with the post office, but I would also call Addicted back and tell them that they are responsible for replacing the lost package. You paid for a product and they did not deliver it properly, their problem not yours.

what law makes the seller responsible? I'm confused. I always thought that the responsibility of the seller is to ship the item, not guarantee shipment, unless the website says otherwise. But, I could be wrong. So, I'm curious!

I had a dear friend send the empty ink spot (12 of them) through the mail and they never got here. I had another friend sent a stamp set and it never got here. I guess some of the PO people are crafters! They see what is in it when they scan it. Honestly? Now I feel like my name is a red flag for crafting items!

LOL omg you are thinking like me... I just moved to a new house so my first thought was, great some lucky lady got my package and it was just the paper and stamps she needed..
Someone bought some stamps from me and it showed delivered on usps. That someone said she didn't receive it, so she looked around but couldn't find it. After a few days she was able to go and ask her neighbor, who had just returned from vacation, and the package was with her neighbor's mail.
With Paypal if there is a delivery receipt saying they delivered the package you are screwed. I have been through this when I have not received a package of things ordered and paid with paypal. As long as the delivery confirmation shows delivered the seller is off the hook. I got screwed. I never got the package...Paypal sided with the seller because of the delivery confirmation. I hope this works out for you.

That's not right. Did you check with the company to make sure they had your correct address?
I would definitely file a dispute with the credit card company. They will take it off your bill while they investigate. I'm sure they will find in your favor if you never received the products. What terrible customer service!
Here is Addicted to RubberStamps' shipping Policy - from their site. You may want to check it out before filing a claim wih them - it may impact the outcome...
You may want to check with your neighbors or at a different entrance if you have one. I know occasionally my packages have been left at my front door - that no one uses. We use our side door. So then packages are missed until I look there as a last resort.

I had a similar thing happen with SU and a UPS delivery that said delivered, but I never recieved. SU replaced the goods and they then dealt with the UPS claim, and I was a very happy customer. Unfortunately, from reading addicted to rubber stamps shipping policy, this is not how they deal with the situation. Very unfortunate from a customer service perspective, and something that is good to know since I do order from them and am never home during the day to accept delivery.
Were you home on the day it shows it was delivered? If you were, then it sure sounds like the Postal Service did not do an adequate job of delivering... either delivering to the wrong address or leaving it out where it could be stolen when you were home. I hope the PO is able to help you find your package!

A seller/store has to get the items to the buyer/customer in the condition they were purchased. If it is lost then the seller has to replace it.
I know I have it on my work computer - let me see if I can find it here at home.

I don't think there is a law that says the seller is ALWAYS responsible for delivery, it depends on the business terms of the seller and when title passes. If terms are FOB shipping point, title passes when transferred to shipper/carrier. If FOB destination, title passes on delivery. Usually if the customer pays for shipping, the terms are FOB shipping point at which point title passes upon shipping and lost items become the loss of the buyer. In practice, the seller will usually take responsibility, even if not legally required to, for customer service sake and because of the fact that is is the seller that has all the shipping information, the relationship with, and legal contract with the carrier.
If there is a law that holds the seller responsible, it likely relates to FOB destination sales and/or is a state law that may or may not exist in other states.
Weird coincidence! About a month ago I was waiting for two orders, one of them ATRS. I tracked the delivery and noted that both parcels were to be delivered the same day in the mail. I stayed home to be there for the delivery. The mail came...no packages. That night I checked the tracking; it said one package had been delivered and the ATRS package had a post card for post office pick-up delivered. Huh? I went to the post office, told them, and they located the one package. Still no ATRS. Two days later a neighbor brought the package and the missing post card by; they had been delivered to the wrong maibox. In my case, I guess it is just sloppy mail delivery...and an honest neighbor. Unfortunately, the latter may be missing in your case.
Delivery/non receit issues always come down to being customer service issues, not questions of law. Besides the fact that the law here is ambiguous, most individuals are simply not going to find it practical to go that route.
The most practical thing to do is check with your post office using the tracking number. You can also file a lost item report with them if that doesnt shake it loose. Also be sure to check with neighbours, family members etc. Credit card companies have different rules on this, so check with yours.
ARGH!! This did happen to me before. It was a package sent on ebay. He did have a proof of mailing reciept. The problem was that the box (priority mail envelope) arrived to me TORN OPEN and half the merchandise had fallen out! The person who sold me the stuff would not even communicate with me.
I was also stonewalled by Ebay and started to complain to Paypal. It took a long time and they ruled in HIS favor because he had a receipt proving that he mailed it!!
I STILL kept on complaining and even sent them a photo of the torn up packaging. I complained that while he may have mailed it, he did not offer me an option of insuring it and his packaging was insuffient for the product. (This was after paypal had "closed" the case and ruled in his favor.) Many emails later, they finally issued me a partial refund. (which was fine since I only lost PART of the merchandise.)
If the store won't help you, your best bet is to go to Paypal or your credit card.
I have talked to the people at the post office. "delivery confirmation" means basically nothing!! I have mailed a package to someone with delivery confirmation and it NEVER SHOWED UP!! I went to my post office about it and was told SO WHAT. Maybe in a smaller town or a nicer post office I would have been helped, but not here.

This happened to me back 6 years ago. I placed a good size order. They charged my CC # and never sent me a DC#.
They told me that it had bee delivered. And that I had signed for it.
Well I knew that was wrong. Cause I never got anything from them.
I looked around and ask my neigbors. No one knew anything about it.
I ask the letter carrier the next week about the package. and he said I had signed for it. And I told him he was wrong.
Well to find out. ATRS. sent it to the wrong address. A computer entry error.
So this is why I never got the package. Or even signed for it. the Letter carrier lied about me signing for it. When ATRS asked about the package.
I never ever got my package from the place they sent it too. (I guess they kept it)
It took me about 3 months to get the charges off my CC. and I swore I would never buy from them again. Because of this... It was there mistake. Not Mine!
I really think they should have replaced the order with the correct address!
Honestly, your package could be anywhere. I check the tracking # on a package and it showed that it was delivered. The package had even been signed for by "the receptionist", huh? I am a SAHM- I have no staff. LOL I was lucky though, the BUSINESS where my package was delivered to took the time to find my phone number and gave me a call that they had my package. I guess USPS didn't check name and grabbed my package by mistake.

I've ordered from ATRS numerous times and every package arrived in perfect condition without any problems. I have however, had my postal carrier deliver other peoples mail AND packages to me many times! It still happens constantly, but I leave the letters and packages at the mailbox for them to deliver correctly. In these days of cutbacks and layoffs, postal workers have to do the work of 2 carriers, plus they're forced to rush through their routes to complete them, and these things are going to happen. I'd discuss it with the post master first and see if he can get your carrier to track down where he delivered the package. If you have no luck there, I'd contact ATRS, but I would tend to think whomever delivered your package is at fault. Good luck either way, I hope you can resolve this issue, because personally speaking, I think ATRS is a great company to deal with!

I live in a gated community and we have small mail boxes, the post office asked the mail lady if she remembered the package, she said she gave it to the gaurd shack who then gave it back and said I refused it.. soooooo not true... when I went to the post office to get it, the lady behind the counter said, oh my I was just going to send that out.. shook my head and thanked her for not shipping it back..
ticks me off because if this was their stuff they would want it handled differnt.. I could not complain to the gaurds because we have a differnt one almost everyday..
the good thing, I got it back and now I can start some christmas stuff..

Glad you were able to find it! It pays to cultivate good relationships with your mail carrier/PO and your neighbors. And apparently your guards.

The time this happened to me (not with this company) the store said they would do nothing about it as well. Then they told me to take it up with the post office. I told them I would take it up with my credit card company. They decided to credit my credit card instead.
I don't think stores having any responsibility for the product after they have a shipping code from the post office but I could be wrong.
I only shop on-line by referral now.
