Good morning! My name is Danielle Wycough, and I am the DT Coordinator at
Shimmerz Paints. I am writing this because we became aware of a situation this week that we felt we should inform others of. The owner of Shimmerz was contacted by someone who claimed that a woman was selling a product with almost the identical name. This woman was also telling her potential customers that "it is just like Shimmerz". After much investigating, we have discovered that this woman is buying Shimmerz, and then repackaging it (at half the size), of course relabeling it, and then selling it as her own. The owner has been in contact with her attorney, and they will prosecute to the full extent of the law if there is a trademark infringement because the formula itself is trademarked along with the name. While looking further into this, and speaking with people who know this woman, we discovered that not only has she done this to Shimmerz, but she has been selling digi stamps that bear a remarkable resemblance to Hanna and Stamping Bella Stamps.
We wanted to inform the stamping community as this does affect many people. It makes an impact on each company because it can cut into their business, which can lead to a loss of income. It also impacts the consumer because prices (as is with every product made) have to be raised in response to legal costs, and can ultimately lead to companies closing their doors. Although we do know that there has been a definite loss of income on our part, Shimmerz is stronger than ever
It's just tough to swallow that someone would be so deliberate to hurt someone else and their business. I always see the good in everything and everyone, and this is just beyond me. I don't even know how they could sleep.
