I figure when I buy something or give something to someone, that I (or the recipient) better be the first one to scratch, dent, nick, or otherwise damage it.
It's one thing if I am aware that I'm buying "used" in advance and decide I still want to buy it. It's entirely another to assume I'm getting something brand new, for the money, and then finding out that is not the case, whether it's for myself, or as a gift for someone. :mad:

I would take it back if the one that purchased it did so assuming it was a new one. If it was discounted because it was used....that would be a different story. If you bought it as "new" then it should be "new!"
I used to work at Michaels and I witnessed this quite a few times. They will take an item back, even if it's defective, used, whatever and refund the person or give them credit and then put the product back on the shelf. This is usually after writing it up as a defective product and claiming it. So they are making money off of it and claiming it. One of the many reasons I dislike shopping there.
I took back my Fiskars trimmer that was defective, but did not have all the original packaging, but I did have the receipt and the cashier didn't want to take it back because they couldn't re-sell it. I argued with her and ended up getting a new trimmer, but they took my packaging so they could use it for my returned trimmer. So some poor unknowing person could buy it again.
So, definately take it back, demand a new one and open it there to make sure it's new!
I used mine right after buying the day after Thanksgiving. Returned it the following week. Nothing wrong with it, but liked the Big Shot better. I ended up buying new B plates to replace the ones I had scratched up so they could sell it as new. I didn't want them to not take it back!
I'd try taking it back (who knows if they'll believe you!!). They probably used it in a demo or someone else returned it. Not good. I learned the hard way to open up the box of anything I buy before I leave the store -- yep, I make the salespeople stand there while I unpack the stuff. Of course, my dh got me a cuttlebug and didn't do that, but luckily, all is well.
