My question is 2 part really. I'm thinking of starting a small candle company. Well, wickless candle company (no flames). And also doing some bath/body products.
1. I have the logo I want, and it's considered "public domain art". I found a rubber stamp with it. So that means I can use that for my logo and no one can say anything, right?
2. If I decided to do this rubber stamped logo, I'll probably put it behind the text, so I'd have to go with a light color, any ideas what brand? I'd need something waterproof for the bath/body products, ie a body butter container. I'd hate for it to rub off. I know I can get waterproof labels, but that's just for the printer ink. I don't know if something like Staz-On would work... I did just check their website and see they have new pastel colors.
I am confused on point #1... I thought each company that has stamps has their own angle policy for their images... I don't know much about "public domain art". To be safe, I would check out the website of the stamp's manufacturer and find out what their angle policy is.
If you're worried about waterproof ink for your bath products, you might want to start from the base of the label itself. A regular paper label will be damaged pretty quickly in the bath. You'd need some sort of laminated label, and if you're going that far, I'd just have them professionally printed. You can always do a handstamped hangtag if you want to add a handmade touch.
If it specifically says that the Angel policy doesn't apply to that particular stamp, you should be in good shape. I'm no lawyer, but "Public Domain" means just that... it belongs to everyone, and no one in particular has the rights to it.

I agree. Many things fall under public domain, such as old, old songs (think happy birthday) and some graphics. Just to play it safe, I would print out and keep a few copies of this statement just in case you're ever asked about it.

Contact (snail or e-mail) the company with the stamp and tell them what you plan to do and request that they send you a release for the use of their stamp for these purposes.
If they refuse to give you premission, AND/OR tell you not to, and you use the image, they could sue you for copyright infridgement...which could be one costly situation!

Actually, "Happy Birthday" is not yet public domain. That's why you won't hear it on TV shows and such.

Yes, you should get permission if you are using their actual stamp, or, if the image is public domain, find a copy of the image and have your own rubber stamp made out of it at an office supply store.
Then, you wouldn't be using someone else's stamp, you'd be using your own.

BTW, Gina K Designs sells really freaky (as in good) labels. You can stamp on them in dye ink and then they become waterproof. They make no sense, but they work!

I have my own line of candles and skin care products. When I used to print my labels on shipping labels I would use Ancient Page ink for color...It is a transparent waterproof ink. Be sure to buy a reinker at the time you get the pad. I now have my labels printed at Lightning Labels...they use a plastic base for the label so they really are water-, oil-, lotion-proof.
