Default Unfroggetable stickers at Michaels

My friend was in Michael's yesterday and took this picture of some stickers that are identical to our Unfroggetable stamp set!? Is this allowed?

wow! No denying that resemblance. Seems pretty ballsy to me that a company would do that.

Does SU really own exclusive rights to all their stamp designs? I ask because I have seen other companies with the exact (not an almost copy) of some SU stamps.

The frogs are cute.

It's possible that they are both using the same copyright free image (Dover is one example).

I think I read somewhere that if they change it at least 10% they can get away with it.

I think it goes both ways. Some of SU's images are close to other company's images as well

So many of the stamp sets and coordinates are starting to resemble each other. Not sure who is leading the way...who is driving the interest towards certain designs and themes....?

I don't go to the conferences. I would guess SU is one of those driving the pack!

the fact that an image is retired is not relevant to whether SU's has a copyright in this design. Furthermore, the "altering it by 10%" is not part of copyright law. No one may take a copyrighted image and then alter it and claim it as a new image. You are supposed to start from a blank slate.

Gee, these laws are violated left and right in the papercraft industry, yet I never hear about any legal actions.

No opinion on the froggy as I have no idea who did what when and who may have licensed the image, etc....

I saw them yesterday at Michaels too. They are so cute, I bought a pack. And they are identical. One of the frogs even has the same crown on that is included in the set.

SU might have allowed it, or the original art may be owned by someone else who licensed it to Stampin' Up and now that it's retired, has licensed it to the sticker company.

And if SU! didn't have an exclusive license, that same designer can sell the rights to those images to as many people as they want, even if the image isn't retired.
