Default Spellbinders patent question. Confused.

I always thought that stamp companies couldn't release dies with open middles because Spellbinders holds a patent for that design. For Christmas I got a set of dies by Quickutz and they also have open middles. Is it just the nesting open middle dies that Spellbinders owns or can other companies make open middled dies too?

I understand that Spellbinders lost the lawsuit on the copyright. I hope I am saying it correctly.

Quickutz has always had some dies with the holes in the middle open.

I'm pretty sure they were around before Spellbinder dies were. (But please don't quote me on this.)

Now Quickutz is owned by Lifestyle crafts.

There are rumblings Spellbinders is considering going after makers of dies that cut AND emboss.......... So- have you noticed the SU dies like do not have the rim- dies like that would not be included........ Or- the Cheery Lynn doily die- it cuts out the shape but does not have an opening to emboss.......
